Article 69. Appointment to the position of data protection inspector
(1) A person who cumulatively meets the following conditions may stand as a candidate for the position of data protection inspector:
- a) he or she holds the citizenship of the Republic of Moldova;
- b) he or she is domiciled in the territory of the Republic of Moldova;
- c) he or she is not subject to a judicial protection measure in the form of guardianship;
- d) he or she has higher education in law or in information technology;
- e) he or she has an unblemished reputation;
- f) he or she has command of the Romanian language.
(2) A person shall be deemed not to have an unblemished reputation, within the meaning of paragraph (1)(e), where he or she:
- a) has a criminal record;
- b) has been deprived of the right to hold certain positions or to carry out certain activities, as a main or complementary punishment, by a final court judgment;
- c) has been found, by a final act, to have breached the legal regime of conflicts of interests, incompatibilities, restrictions and limitations;
- d) is the subject of an irrevocable court judgment ordering the confiscation of unjustified assets;
- e) has, within the last 5 years, entries in his or her professional integrity record concerning a negative result of a professional integrity test for breach of the obligation provided for in art. 7(2)(a) of Law No. 325/2013 on the Assessment of Institutional Integrity;
- f) is subject to a prohibition, arising from a finding act of the National Integrity Authority, on holding a public office or a position of public dignity.
