# Article 3. Territorial scope

Chapter I

(1) This Law applies to the processing of personal data in the context of the activities of an establishment of a controller or a processor in the territory of the Republic of Moldova, regardless of whether or not the processing takes place in the territory of the Republic of Moldova.

(2) This Law applies to the processing of personal data of data subjects who are in the Republic of Moldova by a controller or processor not established in the Republic of Moldova, where the processing activities are related to:

a) the offering of goods or services to such data subjects in the Republic of Moldova, irrespective of whether a payment by the data subject is required; or

b) the monitoring of their behaviour as far as their behaviour takes place within the Republic of Moldova.

(3) This Law applies to the processing of personal data by the diplomatic missions and consular offices of the Republic of Moldova, and by other controllers not established in the Republic of Moldova, where the legislation of the Republic of Moldova applies by virtue of public international law.
